1 - WHAT DO WE DO WITH YOUR INFORMATION?

 When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

 Email marketing : With your permission, we may send you emails about our store and it’s products as well as any special offers, and other updates. You have the right to opt out at any time by using the unsubscribe link at the bottom of the marketing correspondence. 

 

2 - CONSENT  

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

Additionally, if you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Please note that your information will be transferred outside of Europe, including to Canada and the United States.  if you are not happy with this situation please do not use the F9 Audio Website.  

How do I withdraw my consent?.

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting the responsible Data Protection Office

2A Request your data:

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

To help comply with the GDPR ruling ( 2018 ). We have installed a GDPR app on the F9 site that us fully compliant .

The app is crated by Underwaterpistol (UWP). At no time will your data be seen by UWP. UWP have generated application code that creates a data request within the F9 Audio store and generates an industry standard .CSV file. The process is not fully automated and F9 employees have to act on the request for the data to be sent. This additional step is to help ensure all data requests are legitimate 

To request your data, log into your F9 Audio account and click on the 'Request your data' icon in the lower left of the account page . If you do not have an account but have ordered from F9 please create an account with the email address you have historically used at F9 and this will collate all information connected to your email . You may then request the data using the procedure mentioned above. 

If you are unhappy with anything you find in the data you have the right to change it or delete it by contacting the responsible Data Protection Office as mentioned throughout this policy. 

3 - DISCLOSURE

In addition to the disclosures reasonably necessary for the purposes identified elsewhere in this privacy policy, we may disclose information about you:

  1. to the extent that we are required to do so by law;
  2. in connection with any legal proceedings or prospective legal proceedings;
  3. in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).
  4. if you violate our terms of service and we feel your actions need to be reported to a third party for security reasons. 

Except as provided in this privacy policy, we will not provide your information to third parties.

 

4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a professional firewall.

 

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

5. EMAIL COMMUNICATIONS

Necessary email Communication

There are situations which require us to send you emails. These include:

  • Sending a message to your email inbox with the link to activate your account at F9 Audio .
  • Sending a message to your email inbox with the link download any purchased products ( including free products ) 
  • Sending you invoices and order summaries for each completed transaction on our website.
  • Sending you emails concerning technical, legal and support matters.


Please make sure you do not flag F9 Audio as 'Spam' or 'Unsolicited' in your email application. When you register and do not find an activation or download email in your inbox, check your spam folder.

Newsletter

You receive a newsletter by F9 Audio if you have subscribed (opted-in) to a newsletter at any point on our website. 

You can unsubscribe from receiving any/all email communications using the unsubscribe link contained on every single newsletter sent to you from F9 Audio

F9 Audio does not ever send spam. The goal of our existing email communications is to inform our Newsletter Subscribers of the new software releases which are published on a regular basis. Our Newsletters include the links to our new products, information about promotions and latest news from our industry.

We do not sell or distribute (for financial gain or for free) or otherwise disclose any partner or customer e-mail addresses to any third parties except when legally required.

6 - DATA PROTECTION


We can ensure that your data is protected because we provide our customer service through our own staff and not by third parties.

To protect your personal data during transmission to our Shopify Store, we use Secure Sockets Layer (SSL) software. This encrypts all information you transmit to us and can be seen by the HTTPS addresses used at all time whilst visiting F9 Audio

We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of your personal information. As part of these measures we occasionally may ask you to provide proof of your identity before we disclose personal or sensitive information. If we cannot prove your identity we reserve the right to refuse to supply any data until such time that we are satisfied you are the individual you claim to be.

We would like to point out that it is important to protect yourself against unauthorised access to your password and your computer. If you share your computer with others (notably for computers in public areas such as internet cafés and libraries), you should make sure to logout after each session.

Despite all these actions, there is no 100% guarantee against unauthorised third parties gaining access to your data. Consequently, we have to point out that every transmission of data over the Internet is at your own risk. 

 

7 - GOOGLE + GOOGLE ANALYTICS


In the context of disclosure of personal data, we would like to point out Google Analytics, a web analytics service provided by Google, Inc., which uses cookies to help analyse how the website is used. 

The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States of America. 

Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for F9 Audio and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.

Additionally, a so-called User-ID will be used on this website. This ID is not assigned to a particular device, but to you personally. The User-ID enables the analysis of your behaviour across devices (smartphone, tablet, notebook). The allocation of the User-ID to a user ensues once we have unequivocally identified you as a user. This happens generally when you are using your user account. As soon as you have logged-in for the first time, a User-ID is allocated to you accordingly. It contains a unique, persistent, and non-personally identifiable string for a signed user. Once you log into our website the User-ID is sent to Google Analytics. As far as Google is concerned, the User-ID functions as your pseudonym. Google connects your online behaviour and the User-ID to a profile. Google only receives the User-ID, not the information contained in the above-mentioned profile or other personal data of yours. A summarised version of the profile thus created is accessible to us. We do not attach any other of your personally identifiable data to the profile connected to a User-ID. 

F9 Audio uses specific code at the end of the checkout process to record completed purchases and return the value of the sale to Google’s advertising platform. This data will be attached to your User-ID ( as mentioned above ) and is used solely for the purposes of tracking successful advertising and analytical data that is useful for us to improve the services to our customers and improve our product development

Within the scope of its marketing operations F9 Audio uses Google’s program for “interest-based advertising”, so-called remarketing. In the process of this program a special browser cookie is stored on the user’s computer. It is used for serving the user special ads by F9 Audio or Google when visiting other websites.

8 - FACEBOOK

 The F9 Audio website uses plug-ins and pixels created by the social network Facebook (www.facebook.com ). The plug-ins are marked with a company logo of Facebook or the addition "Facebook Social Plug-in. The pixel code does not contain any visual cues and is present at multiple points across F9 Audio.


When you access a part of the F9 Audio website whilst logged into your Facebook account a direct connection to servers of Facebook is set up via the browser.Facebook receives the information that you have visited our website. As long as you are logged in to Facebook, Facebook can assign the visit to the site to your Facebook account and note certain key pages you may have visited. The plug-in and pixel code transmits actions you perform via the plug-in, e.g. pressing a “Like”-Button, completing a purchase or viewing selected content on the F9 Site,

9 - HotJar


This Website uses Hotjar web analytics service. We use the information collected by Hotjar service to improve our website, make it more user-friendly and monitor that it is performing correctly.

Hotjar uses Cookies to obtain information regarding how visitors to this website are interacting with it. In particular Hotjar may record navigation through and interacting with the content on our website. Hotjar may also collect your device’s IP address (collected and stored in an anonymised format), device screen size, device type (unique device identifiers) and browser information, geographic location (country only), preferred language used to display the webpage, referring domain, pages visited, date and time when website were accessed. 10 - TikTok

11 - EU VAT LAWS AS OF JAN 1st 2015

 

 As of 1st Jan 2015 the EU VAT laws changed for anyone supplying Digitally downloadable goods. As result of these laws F9 Audio Ltd is required by EU/UK tax law to keep records of all Transactions that incur VAT for 5 years. This data must contain the customers name and home address, the total coast of the sale, VAT Applied ( at the correct rate for the EU customers home address ) and country identification codes from the Store and Payment Gateways’ transactions .

During the checkout procedure the customer must give an accurate home address that corresponds with their current country of residence as shown on their passport or identification card to allow Shopify to apply the correct rate of EU VAT. We store these details using AES-256 Bit end to end-Encryption. They are not accessible to anyone other than our staff, accountants and UK VAT Office. No banking or card details are included in this information. 

 

12 - THIRD-PARTY SERVICES

 

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

14 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

15 - COOKIES

As well as the cookies mentioned in other parts of this policy , the Shopify Servers generates additional cookies whilst you navigate the store.

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

 _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

 _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

 _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

 _secure_session_id, unique token, sessional

 storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
